On May 26, 2009, the Director of State Courts, A. John Voelker, petitioned this court to create Wis. Stat. § 887.27, Wis. Stat. § 901.08, and Supreme Court Rule (SCR) 70.155, relating to the submission of evidence originating in a language other than English. On November 2, 2009, the court conducted a public hearing in this matter. The Honorable Ralph M. Ramirez presented the petition to the court. At the hearing, Attorney Andrew Chevrez, a representative of the Wisconsin Hispanic Lawyers Association (WHLA), requested additional time to respond to the petition.
At the ensuing open administrative conference, the court held the matter to permit the WHLA to respond.
The
Honorable Juan Colás and the Honorable Elsa Lamelas provided written comments
to the petition on November 20, 2009.
The WHLA filed its written response to the petition on December 1,
2009. By letter dated December 30, 2009,
this court asked the petitioner to consult with the WHLA and Judges Colás and
Lamelas and file a written response to the concerns raised in their letters by
February 1, 2010.
By
letter dated January 29, 2010, the petitioner advised the court that it is
engaged in discussions with the interested parties. The petitioner seeks to ensure that all
interested parties, including the Committee to Improve Interpretation and
Translation in the Wisconsin Courts, have sufficient time to evaluate possible modifications to the
petition. Accordingly, the petitioner
requests an extension of time until March 15, 2010, to provide the court
with an amended version of the petition that has wider support from all
interested individuals and groups.
IT IS ORDERED that the petitioner's request for an extension of time is granted, and the petitioner may file an amended petition by March 15, 2010. Rule Petition 09-03 is held in abeyance until further order of the court.
