BUTLER, JR. would affirm; JUSTICE JON P. WILCOX, JUSTICE N. PATRICK CROOKS, AND JUSTICE PATIENCE D. ROGGENSACK would reverse. CHIEF JUSTICE SHIRLEY S. ABRAHAMSON did not participate.

¶2 Accordingly, the decision of the court of appeals is affirmed.
