Before Hoover, P.J., Stark and Hruz, JJ.
The court has considered a Motion and attached Affidavit of Counsel, representing that Aaron Brewer has retained the law firm of Tracey Wood & Associates as counsel to pursue a motion for postconviction relief in the circuit court. The motion requests withdrawal of the no-merit report filed by prior counsel Daniel Goggin II. Attorney Goggin by his signature “approves” newly retained counsel’s motion, which we construe as a request for substitution of counsel. We will also dismiss the appeal without prejudice and extend the time for filing a postconviction motion.
Therefore, upon the foregoing,
IT IS ORDERED that the appeal is dismissed without prejudice.
IT IS FURTHER ORDERED that the deadline for filing a postconviction motion is extended to sixty (60) days from the date of this order. The request for substitution of counsel is also granted.
