2013AP892-CRNM |
State of Wisconsin v. Michael J. Aschenbrenner (L.C. # 2011CF133) |
|
|
|
Before Blanchard, P.J., Higginbotham and Sherman, JJ.
In response to this court’s order directing counsel to discuss the arguable merit of two potential issues we identified during our review of the record, counsel has notified this court that he now believes that appellant Michael Aschenbrenner has one or more arguably meritorious issues. Counsel asks that we remand the matter and extend Aschenbrenner’s deadlines for seeking postconviction relief under Wis. Stat. Rule 809.30. We will do so.
Therefore,
IT IS ORDERED that the no-merit report is rejected and this appeal is dismissed without prejudice.
IT IS FURTHER ORDERED that the time for Aschenbrenner to file a postconviction motion seeking a new trial is extended to March 25, 2015. Any additional deadlines under Wis. Stat. Rule 809.30 shall be reset accordingly.

Clerk of Court of Appeals
