Jalon Matice Thomas, by Attorney Colleen Marion, moves to
dismiss this no-merit appeal and to extend the time for filing a postconviction
motion. Counsel indicates that,
subsequent to her preparation and submission of the no-merit report, she
identified an issue of arguable merit related to Thomas’s sentence. Because a no-merit report is only appropriate
if counsel is convinced that an appeal would be wholly frivolous, see McCoy
v. Court of Appeals, 486
IT IS ORDERED that the no-merit report in appeal No. 2014AP651-CRNM is rejected and the appeal is dismissed without prejudice.
IT IS FURTHER ORDERED that the deadline for Thomas to file a postconviction motion or notice of appeal is extended to November 25, 2014. See Wis. Stat. Rule 809.82(2)(a) (2011-12).
